MULLICAN|HART WINS AGAIN!

Rob Hart, George Mullican, Michael Womack and Matt Covert just completed a successful two-week trial in Oklahoma County, OK in a contested FELA matter.  Plaintiff, Adam Worthington, alleged that a defect in a step in the yard tower caused him to catch his boot, causing suffer significant injuries requiring surgery.  Plaintiff maintained that as a result of the non-fusion of his L4-L5, he was unable to return to his craft with BNSF Railway Co.  BNSF denied that any defect in the step caused his injuries and that Plaintiff had failed to mitigate his damages.  Represented by famed FELA plaintiff’s attorney Anthony Petru, Plaintiff requested in excess of $6.5 million dollars in damages.  The jury returned a verdict in BNSF’s favor having deliberated less than two hours.
